Article 649 of the Civil Code provides
that “the owner, or any person who by virtue of a real right may cultivate or
use any immovable, which is surrounded by other immovables pertaining to other
persons and without adequate outlet to a public highway, is entitled to demand
a right of way through the neighboring estates, after payment of the proper
indemnity.”
Government has right of eminent domain,
which means if a piece of property is required for a road, railroad or any
other public infrastructure, government can get that property, but must pay the
owner just compensation. Many times, this ends up in court over the computation
of compensation. For private companies it’s more difficult to resolve. Some
cell sites of telecommunication companies or infrastructure projects couldn’t
proceed because of this problem.
